Terms of Use
What you agree to by using BrainTrain, and — just as important — what BrainTrain is not.
Agreement
BrainTrain is operated by Brent Berger, Madison, Wisconsin ("we"). By creating an account or using the app you agree to these terms. If you do not agree, do not use the app.
What BrainTrain is not
This is the most important section on the page, so it comes first.
BrainTrain is an exercise and education product for healthy brain and body habits. It is not a medical device. It does not diagnose, treat, cure, or prevent any disease or condition, including dementia, Alzheimer's disease, mild cognitive impairment, stroke, or concussion.
Nothing in the app, on this website, or in any of our content is medical advice, and using it does not create a doctor-patient or therapist-client relationship. The starting-point questions are self-reported preferences used to pick a difficulty level. They are not a cognitive assessment and produce no diagnosis or score.
If you are concerned about your memory, thinking, or balance — or if something has changed recently — speak with a physician. If you believe you are having a medical emergency, call 911.
Physical activity and your safety
Some activities ask you to move and think at the same time. That combination can affect your balance. Talk to your doctor before starting if you have any condition that affects your heart, balance, joints, or vision, or if you have been advised to limit physical activity.
Use common sense while training: clear the space around you, wear stable footwear, and keep a wall, chair, or counter within reach for any activity done standing. Stop immediately if you feel dizzy, lightheaded, short of breath, or unwell. You take part at your own risk.
Your account
You must be 18 or older. Keep your sign-in details to yourself; you are responsible for what happens under your account. One account per person, and accounts are not transferable.
Access to the program
Access is granted by us and, during the beta period, is enrolled manually. Activities are released on a schedule tied to your enrollment date rather than all at once. We may change the activities, the schedule, or the features of the app as the program develops.
Payment
Where a paid membership is offered, the price, billing period, and cancellation terms are shown at checkout and are what govern that purchase. Payment is handled outside the app. You may cancel at any time; cancellation stops future charges and access continues until the end of the period you have already paid for.
Your content
Messages you send us stay yours. You give us permission to store and read them for the purpose of answering you and improving the program.
Our content
The activities, videos, written material, and the BrainTrain name and logo belong to us. You may use them for your own personal training. You may not copy, redistribute, record, resell, or use them to build a competing product.
Acceptable use
Do not share your account, attempt to reach parts of the service you have not been given access to, interfere with its operation, or use it in a way that breaks the law.
Ending your access
You can delete your account at any time from Account → Delete Account. We may suspend or end access for a breach of these terms, or if we stop offering the service. Deletion is permanent and cannot be reversed.
No guarantee of results
We make no promise about specific improvements to memory, attention, balance, or any other outcome. Individual results vary, and research on cognitive training is genuinely mixed. We describe the evidence honestly and we do not claim more than it supports.
Limitation of liability
To the fullest extent permitted by Wisconsin law, we are not liable for indirect or consequential losses arising from your use of BrainTrain, and our total liability is limited to the amount you paid us in the twelve months before the claim. Nothing here limits liability that cannot lawfully be limited.
Governing law
These terms are governed by the laws of the State of Wisconsin.
Changes
We may update these terms. If a change is material we will tell you in the app before it takes effect. Continuing to use BrainTrain after that means you accept the updated terms.
